14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS. THE AGGREGATE LIABILITY OF THE COMPANY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THE COMPANY FOR ACCESS TO THE WEBSITE IN THE SIX MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

15. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, and agents from claims, damages, and costs arising from your unlawful use of the Website, material you submit, your violation of these Terms, or your infringement of another person's rights.

16. Notice and Opportunity to Resolve Disputes

Before filing a lawsuit, the complaining party must send written notice describing the party's contact information, the specific issue, dates and material facts, alleged injury, and relief requested. Notice to the Company must be sent to rapidsitemaine@gmail.com. The parties will attempt in good faith to resolve the dispute for 30 days after receipt of a complete notice before filing suit.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Maine without regard to conflict-of-law principles. Subject to Section 16, exclusive jurisdiction and venue will lie in the state courts of York County, Maine, or, where federal subject-matter jurisdiction exists, the United States District Court for the District of Maine.

18. Time Limit for Claims

To the maximum extent permitted by law, any claim arising from or relating to the Website or these Terms must be filed within one year after the claim accrued. Claims not filed within that period are permanently barred.

19. Waiver of Jury Trial and Class Proceedings

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS. EACH PARTY AGREES TO BRING CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER OR REPRESENTATIVE IN A CLASS ACTION.

20. Suspension and Termination

We may block or terminate access when we reasonably believe a user has violated these Terms, threatened the Website or another person, or used the Website unlawfully. Provisions concerning intellectual property, submissions, disclaimers, liability, indemnification, and disputes survive termination.

21. Changes to These Terms

We may update these Terms by posting a revised version and changing the "Last Updated" date. Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

22. General Terms

These Terms and the incorporated Privacy Policy constitute the entire agreement concerning use of the Website. If a provision is held invalid, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without prior written consent.
